Terms and Conditions

Last Updated: 5 November 2026

Golden Giving Limited, whose registered office is at 167–169 Great Portland Street, 5th Floor, London, W1W 5PF (Companies House registration number 06688164), trading as People's Fundraising ("PF"), operates https://raffle.stwhospice.org (the "Website"). People's Fundraising provides a digital fundraising platform enabling individuals, groups, and Nonprofits to create and manage fundraising pages, accept donations, process Gift Aid, sell products and memberships, run events, raffles and lotteries (where enabled), manage crowdfunding campaigns, and operate online charity shops. These Terms and Conditions govern your use of all Website features and associated services. Please read them carefully. If you do not agree to these Terms and Conditions, you must not continue to use the Website.

These Terms and Conditions may change or be updated from time to time. It is your responsibility to check these Terms and Conditions whenever you access the Website. The latest version will govern any future use of the Website.

Regulatory and Legal Compliance

You agree to comply with all applicable UK laws and regulatory requirements while using the Website, including (where relevant):

  • The Charity Commission's guidance for trustees and fundraising activities (for example CC20).
  • The Fundraising Regulator's Code of Fundraising Practice.
  • The Gambling Act 2005 and any associated licensing or registration requirements for raffles or lotteries.
  • The Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 when selling goods, services or tickets.
  • Data protection legislation including UK GDPR and the Data Protection Act 2018.
  • Applicable anti-money laundering laws and regulations (for example, Money Laundering Regulations 2017), sanctions screening rules, and wider financial crime prevention requirements.

Nonprofits and users fundraising on behalf of an organisation warrant they are authorised to do so and agree to act in accordance with all applicable laws and guidance.

Eligibility and Account Creation

By creating an account on the Website, you warrant that you are at least 18 years of age. If you are under 18, you may only use the Website to create a fundraising page or event under the direct supervision and written consent of a parent or legal guardian.

You agree to provide true, accurate, current, and complete information when registering an account. You must maintain and promptly update this information.

If you are registering or creating a fundraising page on behalf of a Nonprofit or organisation, you confirm that you have authority to bind that organisation to these Terms and Conditions.

About the featured Nonprofits

The Website enables you to donate to, raise funds for, or otherwise support any Nonprofit, community group, club, or organisation listed on the platform. Each participating Nonprofit enters into an agreement with us authorising PF to collect donations, process payments, and where eligible, reclaim Gift Aid on its behalf under the UK Government's Gift Aid scheme. Nonprofits must be registered with the Charity Commission, OSCR, the Charity Commission for Northern Ireland, HMRC, or otherwise be eligible to receive charitable funds. We also support organisations not eligible for Gift Aid; these are clearly listed as such.

Refunds

We will refund duplicate donations or donations made in error provided the donor requests a refund on the same day the donation was made. For refund requests made outside this period, please contact the relevant Nonprofit or organisation directly, as they are responsible for managing such requests.

Use of your donation

People's Fundraising acts solely as a platform provider and payment intermediary. We are not responsible for how a Nonprofit uses the funds it receives. Unless expressly stated by the Nonprofit, donations may be used for its general charitable purposes. We cannot guarantee that contributions will be restricted to a specific campaign unless explicitly confirmed by the Nonprofit.

Fees and Financial Handling

We charge a transaction fee on payments made through the Website, and our payment service providers may apply their own fees. Details are available at Our Fees. A charge of £25 is made where transfers fall outside standard transfer schedules or where incorrect bank details provided by a Nonprofit result in failed transfers.

Fund Payouts: Funds raised, net of fees and any associated payment processing costs, are typically transferred to the designated Nonprofit or account holder on a regular schedule (for example, monthly). This schedule is subject to verification, fraud checks, and payment processor clearance.

Right to Withhold, Offset, or Recover Funds: PF reserves the right to temporarily withhold, delay, or reverse payments in cases of suspected fraud, chargebacks, legal or regulatory compliance requirements (for example, sanctions screening), or where the Nonprofit/User is in breach of these Terms and Conditions. Furthermore, you authorise PF to offset, deduct, or recover from any outstanding balance or future transfers any amounts owed by the Nonprofit/User to PF, including (without limitation) chargeback fees, reversal costs, or fines incurred by PF due to the Nonprofit's activities or breach of these Terms. PF may also change its fee structure upon providing reasonable notice (for example, 30 days) on the Website.

Payment processing and disbursement of funds are handled through regulated payment providers. Donations are held in designated accounts until disbursed to the intended recipient. PF may require identity verification ("Know Your Customer") before releasing funds. We reserve the right to delay or refuse disbursement of funds if required to fulfil our legal obligations, including anti-fraud and anti-money laundering checks, or if identity verification fails. We may report suspected criminal or fraudulent activity to appropriate authorities.

All card and payment information is handled by PCI-DSS compliant payment service providers. PF does not store full card or bank details on its systems.

Specific Platform Activities (Events, Sales, Lotteries, Crowdfunding, Auctions)

If you utilise the Website to create or manage specific campaign types, the following special conditions apply:

Raffles and Lotteries

If you operate a raffle or lottery (where enabled), you are solely responsible for ensuring compliance with all applicable laws, including the Gambling Act 2005 and any licensing or registration requirements of the Gambling Commission or local authorities. PF acts only as a technology platform and accepts no liability for any failure to comply with these laws. PF may suspend or terminate any page deemed non-compliant.

By law, individuals under the age of 16 (or 18 where applicable) must not participate in lotteries or raffles. You are responsible for implementing appropriate age verification measures to prevent underage participation.

Events and Product Sales (E-commerce)

If you sell tickets, merchandise, or memberships, the Nonprofit or User creating the sales page is the seller of record. The seller is solely responsible for:

  • Compliance with consumer protection laws (including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013), including cancellation rights for eligible buyers.
  • Product/service quality, fulfilment, delivery, and any associated taxes (for example, VAT).
  • Handling all customer service queries, including specific refunds, returns, and dispute resolution for sales/tickets.

PF is not liable for any issues arising from the quality, delivery, cancellation, or legality of products, memberships, or events.

Auctions

If you operate an auction via the Website, you are responsible for listing, fulfilment, and legal compliance (including applicable auction and consumer law). You must deliver items or benefits promised to the highest bidder in accordance with your stated terms and any applicable law, and you are responsible for resolving any disputes with bidders. Unless you clearly state otherwise in your listing, bids may be treated as legally binding offers.

Crowdfunding

The terms of your crowdfunding campaign (including funding targets, timelines and whether funds are released if the target is not met) must be clearly stated on your campaign page. PF is not responsible for the successful execution or outcome of the campaign, nor for any promises or representations made by the campaign owner.

Unauthorized card use

When a donation or payment is made on the Website, the transaction is final unless unauthorised use of your payment card is proven. If you suspect fraudulent use, or if your card has been lost or stolen, you must notify your card provider immediately.

Protecting your password

When you create an account on the Website, you must keep your password confidential. You are responsible for all activity that occurs under your account. If you become aware of unauthorised access, you must change your password immediately. We encourage the use of strong passwords and, where available, two-factor authentication.

Gift Aid information

When you make a donation and confirm that you are a UK taxpayer in accordance with the Gift Aid scheme requirements, PF will reclaim Gift Aid from HMRC on behalf of the benefiting Nonprofit. You are responsible for ensuring that your Gift Aid declaration is accurate. We cannot provide legal or tax advice; you should consult your own advisers for guidance on your tax position.

Privacy and data protection roles

Our Privacy Policy explains how we handle information when we act as an independent data controller and when we act as a data processor for an organisation. It forms part of these Terms and Conditions.

A Nonprofit or other organisation using the platform is the data controller for the donor, supporter, participant, member, customer and fundraising information collected or managed on its behalf for its own purposes. It determines the lawful purposes and use of that information, including any marketing and communications. People's Fundraising acts as the organisation's data processor when we host, store, display, retrieve, secure or otherwise handle that information on its documented instructions.

PF does not sell, commercially exploit or use private organisation-controlled personal data for PF's own marketing, profiling, advertising or unrelated purposes. This does not prevent processing necessary to provide, secure or support the contracted service, comply with the organisation's instructions or meet legal obligations. PF may separately be a data controller where we determine our own purposes and means for specified account, payment, fraud, security, tax or regulatory records.

Each organisation must comply with data protection law in its capacity as controller, including providing privacy notices, selecting lawful bases, honouring applicable preferences and rights, limiting access to authorised persons and issuing only lawful instructions.

Schedule 1: Data Processing Terms for Organisations below forms a binding part of these Terms for personal data processed by PF on behalf of participating organisations. It is intended to set out the processor terms required by Article 28 of UK GDPR, and does not apply to separate processing where PF or a payment provider acts as an independent controller.

User conduct

You must use the Website and its services responsibly and legally. In particular, but not exclusively:

  • You must not upload or post content that incites violence, terrorism, extremism, discrimination or illegal activity.
  • You must not upload content that violates any applicable laws, including charity fundraising regulations, financial crime rules, the UK Equality Act 2010, or FATF guidance.
  • You must not infringe intellectual property rights.
  • You must not upload malware, viruses or harmful code.
  • You must not upload false, misleading, fraudulent or deceptive content, or impersonate others.
  • You must respect the rights and privacy of others and ensure you have permission to upload any personal data, images or media.
  • You must comply with all data protection requirements when handling donor or supporter information provided through your fundraising, membership, shop or event pages.
  • You must not use the Website for any illegal or unauthorised purpose, including unlicensed lotteries, fraudulent activities, or financial wrongdoing.

Failure to comply may result in suspension or termination of your account, removal of content, reporting to relevant authorities, and/or legal action.

If you create a fundraising page, event, crowdfunding campaign, shop, membership product or any other content on the Website, you are responsible for ensuring its accuracy and legality. PF may remove material at its sole discretion where content is inappropriate, unlawful, misleading, unsafe or in breach of these Terms and Conditions.

The Website contains links to third-party websites. Inclusion of a link does not constitute endorsement. Your relationship with those websites is your own responsibility.

Partner services

From time to time we may provide links or access to partner services. Although we aim to work with reputable partners, we are not responsible for their actions, services or content.

Intellectual Property & Content Licence

All content owned by PF on the Website is protected by copyright. The names People's Fundraising, peoplesfundraising.com, associated logos, and branding may not be used without prior written permission.

Other trademarks appearing on the Website belong to their respective owners and may not be used without permission.

All PF-owned content on the Website may only be used for personal, non-commercial purposes unless express permission is granted.

Grant of Content Licence

When you upload or post text, photographs, videos or other public content ("User Content"), you retain all applicable ownership rights. You grant PF a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, format and transmit User Content solely as necessary to operate and display the pages and services you choose to publish, including through our authorised hosting and technical providers. Any separate promotional use of User Content requires appropriate permission.

This licence does not give PF any right to sell, mine, analyse for its own commercial purposes, market to, or otherwise exploit an organisation's private supporter, donor, membership, participant or customer records. Such personal data is governed by the data protection responsibilities and Data Processing Schedule, regardless of the medium in which it is stored.

User Warranties: You warrant that you own or have the necessary licences, rights, consents, and permissions to grant the above licence to PF. You also warrant that your User Content does not infringe the intellectual property, privacy, or other rights of any third party.

PF may retain copies of fundraising pages, events, crowdfunding campaigns, shops, membership products, and other User Content, including after removal or campaign closure, for a reasonable period for purposes of audit, regulatory compliance, fraud prevention, and historical transparency, in line with our Privacy Policy.

You acknowledge that any personal data you choose to include in public User Content (for example on fundraising pages, events, shops or membership products) is disclosed at your own discretion and may be visible to other users and the public. You are responsible for ensuring you have all necessary rights and permissions to include such personal data.

Changes to the service

We may modify, suspend or discontinue any part of the Website at any time without notice. New features are subject to these Terms and Conditions.

Failure to comply and Account Suspension

If you breach these Terms and Conditions, PF may, at its sole discretion, immediately suspend or permanently block your access to the Website and associated services. In the event of suspension or termination due to a breach, PF reserves the right to:

  • Remove any content you have posted.
  • Withhold, delay, or permanently retain funds associated with the breach, particularly where fraud, illegal activity (for example, unlicensed lottery), or a significant chargeback risk is involved, until the matter is resolved with relevant authorities or parties.
  • Report the activity to the relevant authorities (including the Charity Commission, HMRC, or police).

Complaints and Dispute Resolution

If you wish to raise a complaint about your experience with the Website, please contact us at support@peoplesfundraising.com. We aim to resolve issues in accordance with Fundraising Regulator guidance.

If you are not satisfied with our response, you may refer your complaint to the Fundraising Regulator or the UK Information Commissioner's Office (ICO) for privacy-related concerns.

Termination

You may stop using the Website at any time. These Terms and Conditions continue to apply to past use.

Indemnification

You agree to indemnify, defend, and hold harmless Golden Giving Limited (trading as People's Fundraising) and its directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including, without limitation, reasonable legal fees) arising out of or in connection with:

  • Your use of the Website and services, including any transaction, event, or campaign you operate.
  • Your breach of these Terms and Conditions.
  • Any claim by a third party that your User Content or activities infringe their rights (including IP or privacy rights).
  • Your failure to comply with any applicable laws, including tax, consumer protection, or gambling laws (especially regarding raffles/lotteries).

Disclaimer and limitation of liability

Nothing in these Terms and Conditions excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.

The Website is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free or secure access. Maintenance and updates may occur periodically.

Subject to legal exceptions, we are not liable for any loss or damage arising from use of the Website, including indirect or consequential losses, loss of profits, loss of data, or loss of opportunity.

Governing law

These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of the English courts.

Third party rights

A person who is not a party to these Terms and Conditions has no rights to enforce them under the Contracts (Rights of Third Parties) Act 1999, except where required by law or regulatory body.

Schedule 1: Data Processing Terms for Organisations

1. Application and parties. This Schedule forms part of the Terms and Conditions agreed between Golden Giving Limited, trading as People's Fundraising ("PF" or "Processor"), and each Nonprofit or other organisation which accepts these Terms and uses PF to process personal data on its behalf ("Organisation" or "Controller"). It applies only to "Controller Data": personal data processed by PF on behalf of the Organisation for purposes determined by the Organisation. It does not apply to data for which PF independently determines the purposes and essential means of processing, or to processing by an independent third-party controller.

2. Processing details and instructions

  • Subject matter: Hosting and operating the Organisation's fundraising, donation, supporter, participant, membership, event, raffle, auction, shop, payment-administration and related platform services selected by the Organisation.
  • Duration: For as long as PF provides the relevant services and until Controller Data is returned or deleted in accordance with this Schedule, subject to mandatory retention.
  • Nature and purpose: Receiving, recording, organising, storing, securing, retrieving, displaying, transmitting, backing up, supporting, correcting, exporting and deleting Controller Data, as necessary to provide the services configured or instructed by the Organisation and protect their integrity.
  • Data subjects: Depending on the services selected, donors, supporters, fundraising page owners, customers, participants, ticket buyers, members, volunteers, contacts and other individuals whose details the Organisation lawfully collects.
  • Personal data: Names, contact details, identifiers, transactional and participation records, preferences, messages and other details entered into the relevant services. Organisations must ensure that any special-category data or other sensitive information is lawfully collected and appropriate for the selected service.

The Organisation's documented instructions consist of these Terms, the services and settings it chooses within the platform, its authorised users' actions, and any additional lawful written instructions agreed with PF. PF shall process Controller Data only on these documented instructions, including for international transfers, unless required to do otherwise by UK law. Where legally permitted, PF will inform the Organisation before processing under a legal requirement. PF shall promptly inform the Organisation if, in PF's opinion, an instruction infringes applicable data protection legislation, without assuming the Organisation's legal compliance responsibilities.

3. Organisation responsibilities

The Organisation determines the purposes and essential means of processing Controller Data, chooses an appropriate lawful basis, provides privacy notices, manages marketing permissions and data subject rights, ensures submitted information is lawful and accurate, and restricts user access. It may provide further lawful documented instructions within the scope of the service and may request information reasonably necessary to demonstrate compliance with this Schedule.

4. Confidentiality and permitted use

PF shall ensure that persons authorised to process Controller Data are subject to a duty of confidentiality, whether contractual or statutory. PF shall not sell, on-sell, market to, profile, mine, independently analyse or commercially exploit Controller Data for its own purposes. Access and processing shall be limited to what is necessary to provide, maintain, troubleshoot, support and secure the services on the Organisation's instructions or to comply with law.

5. Security

PF shall implement appropriate technical and organisational measures meeting Article 32 UK GDPR, taking account of the risks, including access control, protection of communications and stored information, availability, restoration, monitoring and appropriate testing. Our Security & Data Protection page describes the technical and organisational safeguards used by the service; these may evolve provided that protection is not materially reduced.

6. Sub-processors

The Organisation gives PF general written authorisation to use sub-processors necessary to deliver the service, including providers of cloud infrastructure, data storage, technical communications, monitoring and security, insofar as they process Controller Data on PF's behalf. PF will make information about its relevant sub-processors available on request and inform the Organisation of intended additions or replacements in sufficient time to permit an objection on reasonable data-protection grounds. The Organisation may raise an objection through support@peoplesfundraising.com; PF will seek a reasonable resolution and, if one is unavailable, the parties may discontinue the affected service in accordance with these Terms.

PF shall bind each sub-processor by written obligations that provide at least an equivalent level of protection for Controller Data as this Schedule, including appropriate confidentiality and security measures. PF remains responsible to the Organisation for the sub-processor's performance of its data protection obligations. Providers acting as independent controllers, such as certain regulated payment providers, are not sub-processors simply because they receive transaction information.

7. International transfers

PF shall only transfer Controller Data outside the UK on the Organisation's documented instructions or where UK law requires it, and with an appropriate lawful transfer mechanism where required. This may include an applicable adequacy regulation, a UK International Data Transfer Agreement or an applicable addendum to standard contractual clauses. Our Security & Data Protection page provides further information about infrastructure locations and relevant transfers.

8. Personal data breaches

PF shall notify the Organisation without undue delay after becoming aware of a personal data breach concerning its Controller Data. Notification will include information reasonably available to PF about the nature of the breach, affected information, likely consequences and remedial measures, and will be supplemented as further material information becomes available. PF shall assist the Organisation, taking account of the nature of processing and information available, in meeting its incident response and statutory notification obligations. The Organisation remains responsible for assessing and making any required ICO and data subject notifications for breaches of Controller Data.

9. Data subject requests and compliance assistance

Taking account of the nature of the processing and information available to it, PF shall provide appropriate technical and organisational assistance to enable the Organisation to respond to requests to exercise data subject rights. PF shall also reasonably assist with the Organisation's obligations relating to Article 32 security, Articles 33 and 34 breach notification, Article 35 data protection impact assessments and Article 36 prior consultation. Where PF receives a request relating solely to Controller Data, it shall direct the requester to the relevant Organisation or notify the Organisation as appropriate, unless legally obliged to respond otherwise.

10. Access, export, return and deletion

The Organisation may access and retrieve Controller Data using authorised platform functions. Where reasonable assistance is needed to obtain Controller Data, the Organisation can contact PF support; the available scope and format will depend on the relevant records, service features and lawful permissions.

At the end of the relevant processing services, PF shall, at the Organisation's choice, return or securely delete Controller Data and delete existing copies, unless UK law requires retention. The Organisation should communicate its choice before or when requesting closure. Pending the end of the applicable protected backup cycle, residual copies must be secured, isolated from routine use and subsequently deleted. Data PF lawfully retains in its separate independent-controller capacity is subject to its own lawful purposes, retention limits and the Privacy Policy.

11. Demonstrating compliance and audits

PF shall make available to the Organisation information reasonably necessary to demonstrate compliance with Article 28 obligations and allow for and contribute to audits and inspections conducted by the Organisation or an auditor mandated by it. The parties will coordinate reasonable arrangements for scope, notice, confidentiality and protection of other customers' data and platform security, without preventing the Organisation from exercising its applicable statutory audit rights. PF shall notify the Organisation if, in its opinion, a requested audit instruction infringes applicable data protection law.

12. Interpretation

For Controller Data, this Schedule takes precedence over any inconsistent general provision of these Terms or other platform descriptions. A public description of security or privacy practices does not limit the mandatory rights and obligations in this Schedule. Nothing here relieves either party of its own obligations under applicable data protection law. Questions about this Schedule may be sent to support@peoplesfundraising.com.
